2. PRODUCT AND SERVICE INFORMATION SUBJECT TO THE CONTRACT
2.1.The subject of this Agreement is to inform the consumers in accordance with the provisions of the Law No. 6502 on the Protection of Consumers and the Regulation on Distance Contracts published in the Official Gazette dated November 27, 2014 and numbered 29188 regarding the rental service sold to the CUSTOMER by the Car Rental Company (PRINCIPAL SERVICE PROVIDER), which provides car rental services through the website named www.obilet.com ("Website") and the mobile application named Obilet ("Mobile Application") (Website and Mobile Application will be referred to as "Platform" together and separately).
2.2.The service subject to this contract is a car rental service; reservation number, CAR RENTAL COMPANY reservation number if separate, information of the rented vehicle, rental period, vehicle pick-up and return dates, vehicle pick-up and return location, address, rental price, discount or coupon information, if any, the last amount paid and/or to be paid at vehicle delivery, the information at the time of termination of the order are also sent to the email address specified by the CUSTOMER as follows or in content close to it.
2.3.At the time of delivery of the vehicle, you must have your credit card with your name and surname written on it and with which you purchased the rental service. In accordance with the service purchased, a deposit amount that will vary according to the vehicle type will be blocked from your credit card. 2.4.Even if the contract has been concluded, any increase in the price of car rental due to increases in tax amounts and increases in prices by the RENTER will be reflected in the rental price. For this reason, additional payments may arise at the time of delivery of the vehicle presented to the information of the RENTER.
2.5.Obilet Bilişim Sistemleri A.Ş. is only and solely the operator and user of the Platform; it is not a party to the contract regarding the service to be provided to the CUSTOMER by CAR RENTAL COMPANY, nor does it have any responsibility for the fulfillment of the rental service subject to the relevant contract. In this context, Obilet Bilişim Sistemleri A.Ş. shall not be a party to any disputes that may arise between CAR RENTAL COMPANY and CUSTOMER.
3. VALIDITY PERIOD
3.1.All information and promises provided to the CUSTOMER regarding the product or service in this form are valid until the realization of the service, and after the completion of the service provision, the CAR RENTAL COMPANY hereby warns that it is not bound by the information and promises given in this form.
4. RIGHT OF WITHDRAWAL
4.1.Pursuant to provision 15/1-g of the Regulation on Distance Contracts, which entered into force after being published in the Official Gazette No. 29188, as directed by the provision 48/6 of the Law No. 6502 on the Protection of Consumers; the CUSTOMER has no right of withdrawal in terms of this Agreement.
4.2.Certain CAR RENTAL COMPANIES grant the CUSTOMER the right of withdrawal on their initiative; in this context, the provisions of the contract that the CUSTOMER has made with CAR RENTAL COMPANY are reserved. In this direction, the Car Rental and Usage Rules determined by the CAR RENTAL COMPANY are stated in the relevant section by Obilet for each vehicle; CUSTOMER is obliged to read these rules before completing the payment process.
5. VALIDITY
5.1.After this Preliminary Information Form is read and accepted electronically by the CUSTOMER, the stage of establishing a Distance Car Rental Service Agreement will be initiated.
6. COMPETENT COURT
6.1.The CUSTOMER and CAR RENTAL COMPANY may apply for complaints and objections to the consumer problems arbitration committee or consumer court in the place where the consumer purchases the goods or services or where the consumer resides within the monetary limits determined by the Ministry of Commerce in December each year.
6.2.In the applications to be made to the Consumer Arbitration Committees, the District and Provincial Consumer Arbitration Committees in charge should take into account the current amounts published in the Official Gazette every year.
This Preliminary Information Form is an annex and an integral part of the Distance Car Rental Service Agreement.
